PRIVACY POLICY 

This is the Privacy Policy of BONI GYM B.V. (hereinafter referred to as "BONI GYM," "we," "us" or "our"), a company having its address at Klipperweg 12, 1113 GW Diemen. BONI GYM is registered with the Chamber of Commerce under number 83039910. Our Privacy Policy explains how we collect, use, share and protect information in relation to our website www.bonigym.com (the "Service"). We collect this information when you visit our website with your computer, tablet, phone or smartwatch ("Computer"). We process personal data in a manner that is in accordance with the General Data Protection Regulation (the “GDPR”), the GDPR-based legislation and the other current privacy legislation.

By using the Service, you understand and agree to the collection and use of information in accordance with this Privacy Policy. Our Privacy Policy applies to all visitors, users, and others who access the Service ("Users").

What kinds of information do we collect?

Information you provide

We collect the following information you provide us with directly:

  1. Your username, password and e-mail address when you register for an BONI GYM account;

  2. Profile information that you provide for your user profile;

  3. Communications between you and BONI GYM (e.g., we may send you Service-related

    emails);

Log file information

We collect information that your browser sends whenever you visit our Service. This log file information may include information such as your computer's Internet Protocol address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

Analytics services (non-personally identifiable information only)

We use third-party analytics tools to help us measure traffic and usage trends for the Service. These tools collect information sent by your device or our Service, including the web pages you visit, add-ons, and other information that assists us in improving the Service. The tools use ‘cookies’, which are text files placed on your device, to collect your log information and behaviour information in an anonymous form. Cookies cannot damage your device or the files on your device. We collect and use this analytics information with analytics information from other Users so that it cannot reasonably be used to identify any particular individual User. With respect to Google Analytics, although Google Analytics plants a permanent cookie on your web browser to identify you, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits by disabling cookies. 

Purposes of processing data

By using our Service, you leave certain information with us, for example by creating an account. This may include data such as name, e-mail address, place of residence, telephone number and payment details. «=naam_kort» collects and processes this data to make our services accessible. We also collect information about your Computer (such as IP address, browser type and operating system) so that we can improve our services. The personal data will not be provided to third parties unless we are obliged to do so on the basis of legislation and regulations.

Legal basis for processing data

Mobile Terms of Service

The BONI GYM mobile message service (the "Service") is operated by BONI (“BONI GYM”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to BONI GYM’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of BONI GYM through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with BONI GYM. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to BONI or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other BONI GYM mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

For Service support or assistance, text HELP to BONI or email mail@bonigym.com.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Change of control 

If we sell or otherwise transfer part or the whole of BONI GYM or our assets to another organisation (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information collected through the Service may be among the items sold or transferred. The buyer or transferee will have to honour the commitments we have made in this Privacy Policy. 

Legal requests and preventing harm

We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. Safety and security


BONI GYM has taken appropriate technical and organisational measures by using the latest technologies to protect your information against loss or unlawful processing. We use safeguards to help keep the information collected through the Service secure and take steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, BONI GYM cannot ensure the security of any information you transmit to BONI GYM or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed. We request you to do your part to help us. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and BONI GYM, at all times. We are not responsible for the functionality, privacy, or security measures of any other organisation.

International transfer

Your information may be transferred to, and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. If you are located outside Netherlands and choose to provide information to us, please note that we transfer the information to The Netherlands. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Third-party applications, websites and services

We are not responsible for the practices employed by any applications, websites or services linked to or from our Service, including the information or content contained within them. Please remember that when you use a link to go from our Service to another application, website or service, our Privacy Policy does not apply to those third-party applications, websites or services. Your browsing and interaction on any third-party application, website or service, including those that have a link on our Services, are subject to that third party's own rules and policies.

Children's privacy

Our Service does not address anyone under the age of 13 or 16 ("Children"), depending on the applicable EU privacy rules. The age threshold for obtaining parental consent varies between 13 and 16 years. We do not knowingly collect personally identifiable information from children under 13 or 16. If you are a parent or guardian and you are aware that your Children has provided us with personal information, please contact us. If we become aware that we have collected personal information from a child under age 13 or 16 without verification of parental consent, we take steps to remove that information from our servers.

In accordance with the law, BONI GYM does not retain data any longer than is required for attaining the purposes for which they were collected unless BONI GYM is obliged to do so based on a legal provision.

BONI GYM may modify or update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

GYM Privacy policy

1. Persoonsgegevens

Met het begrip “persoonsgegeven” wordt informatie bedoeld waarmee jij als persoon geïdentificeerd kan worden. BONI GYM maakt gebruik van persoonsgegevens die zijn verstrekt als klant, lid, sporter, leverancier, opdrachtnemer, bezoeker van de website (www.bonigym.com) of relatie. BONI GYM verwerkt deze persoonsgegevens alleen voor het doel waarvoor de gegevens zijn verkregen.

Het gaat om de volgende persoonsgegevens:

  • voor- en achternaam
  • adresgegevens
  • telefoonnummer
  • e-mailadres
  • betaalgegevens
  • BTW identificatienummer
  1. Grondslag

BONI GYM verwerkt alleen gegevens als daar een zogeheten “AVG-grondslag” voor bestaat. Het komt erop neer dat wij in principe alleen gegevens verwerken als jij daar expliciete toestemming voor hebt gegeven, of als dat nodig is voor de uitvoering van de overeenkomst die met BONI GYM is gesloten.

  1. Doelen

De persoonsgegevens kunnen worden verwerkt in de volgende situaties:

  • Je bent lid van BONI GYM;
  • Je komt (proef)sporten bij BONI GYM zonder lidmaatschap;
  • Je hebt een overeenkomst met BONI GYM;
  • Je hebt je contactgegevens achter gelaten op de website van BONI GYM;
  • Wij onderhouden een zakelijke relatie;
  • Je hebt aangegeven graag op de hoogte te worden gehouden van relevante ontwikkelingen en activiteiten, al dan niet door middel van een nieuwsbrief.

BONI GYM deelt nooit gegevens met derden voor commerciële doeleinden.

  1. Bewaartermijn

De persoonsgegevens worden bewaard zolang dat nodig is voor de uitvoering van de overeenkomst. Na afloop van een lidmaatschap, worden de persoonsgegevens bewaard als en zolang daar toestemming voor is gegeven. Ten behoeve van de financiële administratie en om te voldoen aan de de eisen die de Belastingdienst daaraan stelt, worden persoonsgegevens daarna bewaard zolang BONI GYM daartoe wettelijk verplicht is.

  1. Nieuwsbrief

BONI GYM biedt nieuwsbrieven aan. Zo blijf je op de hoogte van aanbiedingen en ander nieuws. Bij communicatie langs deze weg wordt altijd een afmeld-mogelijkheid opgenomen.

    6. Beveiliging

We doen er alles aan om jouw persoonlijke gegevens te beschermen tegen verlies, vernietiging, gebruik, wijziging of verspreiding van uw persoonlijke gegevens door onbevoegden. De toegang tot digitale bestanden met persoonsgegevens is versleuteld met gegenereerde (dus hele sterke) wachtwoorden, en de kring die toegang heeft tot deze bestanden is beperkt tot een aantal personen. Hierdoor kunnen degenen die niets met jouw gegevens te maken hebben, er niet bij.

  1. Verwerkers

Een verwerker in de zin van de AVG handelt in opdracht van de verwerkingsverantwoordelijke bij het verwerken van persoonsgegevens, zonder onder diens rechtstreeks gezag te staan. BONI GYM kan gebruik maken verwerkers. Deze partijen gebruiken jouw gegevens alleen in overeenstemming met de instructies die wij geven en niet voor eigen doeleinden. BONI GYM is verplicht een verwerkersovereenkomst met hen te sluiten waarin dat is vastgelegd.

     8. Links

Op onze website kunnen links naar andere websites staan. Wij zijn niet verantwoordelijk voor de inhoud of de privacybescherming van deze websites. We adviseren jou dan ook om altijd de privacy policy van de betreffende website te lezen.

   9. Cookies

Een cookie is een klein tekstbestand dat via de server van een website naar de browser wordt gestuurd. De browser slaat het bestandje vervolgens op in je apparaat. BONI GYM maakt gebruik van Google Analytics, en dus is er een cookie door Google geplaatst op onze website. Daardoor krijgen wij rapportages over hoe de bezoekers de website gebruiken. Google kan deze informatie aan derden geven als Google hiertoe wettelijk verplicht is, of voor zover derden de informatie namens Google verwerken. Wij hebben hier geen invloed op. Wij hebben Google géén toestemming gegeven de gegevens te delen met derden.

We kunnen cookies gebruiken om uw ervaring op onze website te verbeteren. Cookies zorgen er daarnaast o.a. voor dat de website snel is, jij onze website veilig kunt bezoeken en wij fouten op onze website kunnen opsporen.

Je kunt cookies altijd zelf via de browserinstellingen verwijderen of uitschakelen. Er worden dan geen cookies meer opgeslagen als je onze website bezoekt. Maar let wel op: zonder cookies werkt onze website mogelijk minder goed.

   10. Wijziging van de privacy policy

Wij kunnen deze privacy policy aanpassen. Als wij de privacy policy in belangrijke mate veranderen zullen wij een notificatie op onze website plaatsen samen met de nieuwe privacy policy. Wij zullen klanten en relaties die met hun e-mailadres bij ons geregistreerd staan per e-mail op de hoogte brengen bij wijzigingen.

   11. Uw rechten

De gegevens die we van jou verzamelen zijn persoonlijk. Je hebt daarom de volgende rechten:

  • je mag ons vragen om inzage in uw gegevens;
  • je mag ons vragen om correctie, beperking of verwijdering van jouw gegevens. In geval van fraude, wanbetaling of andere onrechtmatige handelingen kunnen wij enkele gegevens van jou bewaren in een register of op een zwarte lijst;
  • je mag ons vragen om een kopie van uw gegevens. Wij kunnen deze kopie – op uw verzoek – ook aan een andere partij doorgeven, zodat je dit zelf niet meer hoeft te BONI GYM;
  • je kunt bezwaar maken tegen de verwerking van jouw gegevens;
  • je kunt een klacht indienen bij de Autoriteit Persoonsgegevens, als je denkt dat wij uw gegevens onrechtmatig verwerken;
  • je mag uw toestemming om uw gegevens te verwerken altijd weer intrekken. Vanaf het moment dat je de toestemming intrekt mogen we dan geen gegevens meer van jou verwerken.
